Supreme Court Heads Into New Term
After bulking up the Supreme Court's docket last week with 17 additional cases, the justices head into their new term today facing a full array of hot button issues that will continue to measure just how far to the right the Roberts Court is heading on the eve of a presidential election. And at least one keen Court-watcher predicts that simply because of the different lineup of cases this term, by next June it will be conservatives, not liberals, who will be angry at the Supreme Court.
Judge: Qualcomm Firms Can Disclose Work Product
A federal magistrate cleared the way Friday for Qualcomm's former outside litigators to publicly explain their roles in the company's failure to turn over hundreds of thousands of discoverable documents. And if the lawyers' explanations don't adequately get to the truth of what happened, the judge will consider sanctions against Qualcomm itself, according to attorneys involved in the case. The judge had earlier threatened sanctions against all of Qualcomm's outside counsel.
Morgan Lewis' Business/Finance Head Joins Orrick
Orrick, Herrington & Sutcliffe is set to announce today that it has recruited to its New York office the head of the business and finance practice at Morgan, Lewis & Bockius. Howard L. Shecter will join Orrick's mergers and acquisitions group and is expected to take a lead role in expanding the practice in New York. A veteran deal lawyer, Shecter had been one of the most senior partners at Philadelphia-based Morgan Lewis.

Silicon Valley Sees Hot Day in the In-House Market
GC Donald Rosenberg's sudden exit from Apple shook Silicon Valley Friday -- as did the news that his high-profile replacement is Oracle Corp.'s Daniel Cooperman. Rosenberg, who joined Apple last fall as the company grappled with stock option backdating trouble, will stay in California at San Diego-based Qualcomm Inc., a company with its own share of legal troubles, including a wide array of litigation against rival Broadcom. Missouri Firms Explore Possible Merger
Leaders from Blackwell Sanders and Husch & Eppenberger say they are in the early stages, "with serious intentions," of a possible merger. Blackwell Sanders, based in Kansas City, Mo., has about 330 attorneys, while Hush & Eppenberger, based in St. Louis, has about 300 attorneys. A merger deal would create the second-largest firm in Missouri.
Okla. Attorney Jumps From Fifth-Floor Hospital Room
An attorney accused of robbing a pharmacy jumped head first from his fifth-floor hospital room in Oklahoma City on Thursday, landing on the roof of a two-story building. Robert Behlen "vaulted himself" through a window in his room as members of a sheriff's office tactical team tried to reach him from an outdoor ledge. "Obviously, he was intent on trying to commit suicide," says Sheriff John Whetsel. Behlen was listed in critical condition Thursday evening to repair a fractured pelvis and dislocated hip.
N.Y. Judge to Step Down at Year's End After Admitting to Misconduct Charge
Family Court Judge Marian R. Shelton cut a deal Thursday with the New York Commission on Judicial Conduct under which she acknowledged that she had violated the conduct code's injunction that judges be "patient, dignified and courteous" when she ordered the wife of a court clerk in her Bronx courtroom handcuffed and jailed over a weekend. The judge was allowed to remain on the bench until her term ends Dec. 31 without any sanction.

Bristol-Myers Squibb to Pay $515M to Settle Probes of Drug Marketing
Bristol-Myers Squibb Co. and a former subsidiary have agreed to pay more than $515 million to settle federal and state investigations into their drug marketing and pricing practices. The civil settlement resolves a broad array of allegations against the company, and is the latest in a series of settlements the Justice Department has reached with pharmaceutical companies over illegal marketing of their drugs.
Former Judge's Indecent Exposure Conviction Upheld
An Oklahoma state appeals court has upheld the conviction of a former judge who was convicted of exposing himself by using a sexual device while presiding over trials. Former District Judge Donald Thompson was sentenced in 2006 to four years in prison on four counts of indecent exposure. On Thursday, the Oklahoma Court of Criminal Appeals ruled that "sufficient chain of custody was established for admission of a penis pump" the judge had been accused of using behind the bench.
