Are Big Firms Warming Up to Alternative Fee Deals?

With hourly rates continuing to skyrocket at big firms, clients are pushing alternative fees as a way to control costs -- and law firms say they are listening. While the billable hour is still the most common calculation, fixed fees for larger work volumes or success-based arrangements are getting more attention, firms say. Yet one industry insider says alternative fees are like teenage sex. "There are more people talking about it than doing it, and those that are doing it don't know what they're doing."


When in Doubt, Look to Roberts for Outcome of Supreme Court Cases

In 2004, then-appeals court Judge John Roberts Jr. tested a theory for predicting Supreme Court outcomes. Using oral argument transcripts, he tallied the number of questions that justices asked of advocates in a sampling of cases. Eighty-six percent of the time, Roberts reported, the lawyer for the party that ultimately lost had gotten the most questions. A new study of arguments leading to 5-4 decisions indicates that, as chief justice, Roberts affirms that pattern more than any other active questioner.


Former L.A. Doctor Pleads Guilty in Milberg Kickback Scheme

Former California physician Steven G. Cooperman pleaded guilty to a federal conspiracy charge on Tuesday for his role in a lawsuit kickback scheme that prosecutors said netted more than $200 million for the Milberg Weiss law firm. Prosecutors claimed that the firm paid more than $11.3 million in attorney fee kickbacks between 1984 and 2005 to people who agreed to be plaintiffs in more than 150 lawsuits against companies such as PG&E, United Airlines and Sun Microsystems.


Chicago's Midsize Law Firms Look to Stay Independent

Midsize law firms are staking out plans for staying independent but are open to mulling merger options, following moves this past year by rivals to hook up with larger firms. Those midsize firms reject the notion that they don't have the wherewithal to meet the global needs of big corporate clients. Not maintaining offices in places such as Hong Kong and Paris helps Schiff Hardin keep its costs down, and its billing rates are 10 percent or more below those of larger firms, says managing partner Ron Safer.

Plaintiffs lawyers are filing more class actions against companies under state consumer-protection laws in conjunction with, or even in place of, traditional personal injury class actions, which have become too difficult to certify. A Massachusetts state commission filed ethics charges against a judge who won a $2 million libel award from the , accusing him of misconduct for writing threatening and intimidating letters to the newspaper's publisher. The commission alleged that Superior Court Judge Ernest Murphy engaged in "willful misconduct" that was unbecoming of a judicial officer and cast the judicial system in a bad light. Murphy admitted he wrote and sent the letters, but denied engaging in misconduct.


Images From Cell Phone Camera Suppressed in Subway Groping Case

A man charged with groping women on the subway has successfully moved to suppress the photos and videos of the victims' buttocks he allegedly took with his cell phone camera. Manhattan Criminal Court Judge Anthony J. Ferrara found that an arresting officer's viewing of the pictures constituted a warrantless search and that neither of the prosecution's two proffered exceptions to the Fourth Amendment's requirement for a warrant applied.


Defense Launches in Brocade Backdating Trial

Northern District of California Judge Charles Breyer on Monday delayed ruling on a defense motion to dismiss the backdating prosecution of ex-Brocade Communications CEO Gregory Reyes. On Friday, Breyer had grilled prosecutor Timothy Crudo on the question of intent, and ordered him to submit a brief explaining how the evidence addressed that issue. On Monday morning, he filed 18 pages on the issue, and Breyer said it would be at least several days before he rules.


D.C. Bar Counsel Calls for Suspension of Lerach Coughlin Partner

The D.C. Bar Counsel is recommending that former federal prosecutor G. Paul Howes be suspended for at least two years from practicing law in the District for his misconduct in a witness payment scandal. Howes -- an Assistant U.S. Attorney in the District in the 1990s and currently a partner at Lerach Coughlin Stoia Geller Rudman & Robbins -- testified that poor training, a heavy caseload and a desire to help people in need led him to approve improper witness payment vouchers.


N.Y. Chief Judge Explains Her Deferral of Pay Hike Suit

In an e-mail to New York judges, Chief Judge Judith S. Kaye explained her reasons for deferring a suit over the lack of judicial raises since 1999, saying, "As lawyers and judges, we have all spent our lives dealing with litigation, and know that -- rather than a sign of weakness -- sometimes real strength lies in deferring potentially counterproductive action." Litigation is being pursued by others, including at least four judicial associations, which will meet with attorneys next week to finalize a suit.


Jews for Jesus Group Sues Town in Free Speech Dispute

The organization Jews for Jesus has filed a federal court action against Oyster Bay, N.Y., claiming a section of the town code is unconstitutional because it prevented the group's members from freely distributing leaflets in a public park. The organization and one of its employees argue that the provision violates the First Amendment because it creates an unconstitutional prior restraint on protected speech.
