Defense Cost Estimates Offered in KPMG Case

Several defense attorneys representing former KPMG partners say their clients would need anywhere from $10 million to $44 million to mount a reasonable defense to what has been called the largest criminal tax fraud in U.S. history. The defendants claim their rights were violated when KPMG, in response to pressure from the government, declined to reimburse them for their legal costs. A New York federal judge agreed that the government had coerced KPMG, and is now trying to come up with a remedy.


BALCO Lawyer Gets 30-Month Prison Term

The winds shifted Thursday for Troy Ellerman, the lawyer who leaked grand jury transcripts from athletes testifying in the BALCO steroids probe and who got a 30-month sentence as his reward. Last month, Judge Jeffrey White -- irked that Ellerman had not only leaked the transcripts but repeatedly lied about it -- had refused to accept Ellerman's plea deal because he felt the sentencing range of 15 to 24 months was too lenient. But at Thursday's hearing, White said he was planning to approve the deal.

Nine people filed a $1.3 million lawsuit Thursday against Andrew Speaker, the globe-trotting tuberculosis patient, for possibly exposing them to the disease on a flight from Prague to Montreal. Lawyer Anlac Nguyen filed the motion in Quebec Superior Court on behalf of seven Canadians and two natives of the Czech Republic. "They do not have tuberculosis, but nobody can say that they won't have tuberculosis either," Nguyen said of his clients. He believes more passengers may bring action against Speaker.


N.J. Ethics Panel Finds Judge Abused Office by Interceding in Son's Dispute, Urges Censure

New Jersey's high tribunal for judicial ethics transgressions says censure is the appropriate discipline for Supreme Court Justice Roberto Rivera-Soto for misusing his office to advance a personal interest. The panel found the judge violated canons of ethics and a court rule by speaking to police, prosecutors and court officials about a criminal case in which his son was the complaining witness. Rivera-Soto also faces a potential civil suit for emotional distress from the teenager who clashed with his son.


Divorce Mediation Centers Subject to Lawyer Ethics Rules, Committee Says

A court ethics committee has warned New Jersey lawyers who run divorce mediation centers that they are covered by the Rules of Professional Conduct, and the panel has found one center in violation. The committee issued an opinion Wednesday that is an ethics primer for lawyers who own or work for such centers. Though lawyers in the centers may tout themselves as third-party neutrals, they are offering legal advice and the sums they collect are legal fees, the opinion says.


District Attorney in Ga. Teen Sex Case Under Fire

A group of legislators and activists wants Douglas County, Ga., District Attorney J. David McDade punished for giving lawmakers an explicit video in an effort to block legislation that could have freed a teenager convicted in a sex case. The video is said to show Genarlow Wilson, then 17, having oral sex with a 15-year-old girl. A judge has said the girl's participation appeared "voluntary," but the act was a felony under state law at the time, and Wilson was sentenced to a mandatory 10 years in prison.


House Panel Takes First Step Toward Contempt of Congress Proceedings Against Miers

A House panel cleared the way Thursday for contempt proceedings against former White House counsel Harriet Miers after she obeyed President Bush and skipped a hearing on the firings of federal prosecutors. Rep. Linda Sanchez ruled out of order Bush's executive privilege claim that his former advisers are immune from being summoned before Congress. The White House said Bush was willing to make Miers available for interviews, but only behind closed doors and without a transcript.


Former Spector Lawyer Testifies About Allegedly Missing Evidence

A former lawyer for Phil Spector reluctantly testified under threat of jail Thursday that she saw a famous defense forensic expert pick up a small white object at the scene of Lana Clarkson's death. Sara Caplan said the object was not the size of a missing piece of the actress' fingernail. Prosecutors contend the item could be evidence of a struggle but was never turned over to them. Caplan had earlier refused to testify about the item, after which a Superior Court judge ruled her in contempt of court.


Judge Freezes Cash Sought in Dispute With Ex-Lawyer in Anna Nicole Smith Case

A judge froze a half-million-dollar account Thursday until it's decided whether the money belongs to Larry Birkhead or his ex-lawyer in the Anna Nicole Smith paternity case. Attorney Debra A. Opri contends that Birkhead owes her more than $600,000 for her legal work on his request for DNA testing of Smith's baby daughter -- testing that in April showed he was the father.


Wigs Off for U.K. Civil, Family Judges

Civil and family court judges in England and Wales will dispense with their wigs next year, although the antique fashion will continue in the criminal courts, the lord chief justice said on Thursday. Judges will also wear the same gowns throughout the year, Lord Phillips of Worth Matravers announced. The government will save about $600,000 a year by simplifying court dress and no longer giving new circuit judges an allowance to purchase a full-bottom wig, Phillips says.
