Mention the President, Lose a Case?

Apparently President George W. Bush has become so unpopular, some lawyers believe the mere mention of his name in front of a jury could tip the scales against them. In a civil rights lawsuit by an 82-year-old doctor who claims he was falsely arrested for displaying an anti-war sign at a Bush campaign event, defense lawyers recently asked the judge to prohibit the plaintiff from saying Bush's name. Bush's identity, they argued, "in and of itself, presents the danger that the jury will favor plaintiff."



Andrews Kurth Raises First- and Second-Year Associates' Salaries

One day after Vinson & Elkins' announcement that it was raising Texas and Washington, D.C., associates' salaries, Andrews Kurth managing partner Bob Jewell told associates that the firm will increase first-year associate salaries to $160,000 and second-year associate salaries to $170,000 in its Texas and D.C. offices effective Aug. 1. In an interview, Jewell says Andrews Kurth's management committee is looking at the novel structure V&E unveiled to increase third- through eighth-year associates' salaries.


Profits at U.K.'s Top 50 Law Firms Hit Record Levels

The United Kingdom's top 50 law firms have seen a second year of double-digit revenue growth, with fees rising 14 percent annually to hit £10.5 billion. 's 2006-07 figures also show average profits per equity partner going up by 13.5 percent. What's more, the four largest firms generated £4.18 billion in fees among them, nearly 40 percent of the top 50's income. Clifford Chance managing partner David Childs said the results vindicated the big four firms' investment in their foreign offices.


Expanding Law Firm Tests Market With TV Ads

Morgan & Morgan has used TV advertising to build one of Florida's largest personal injury practices. Now the 100-lawyer firm wants to do the same in Georgia by combining with two firms to launch a 14-lawyer Atlanta office. Morgan started testing the waters a year and a half ago, when it began advertising in Atlanta on TV, on the radio, in the Yellow Pages and on billboards. Partner James Kelleher says the response "was in excess of what we'd set as a goal. That told us it was a market we should be in."

Corporation Loses Its Attorney, Then Its Case

A civil court judge has granted a default judgment against a corporation that was originally represented by an attorney but lost its "hired gun" and did not retain a substitute. In awarding the judgment for Mark Landsberg Consulting in its suit against Terral Corp., Manhattan Civil Court Judge Arthur F. Engoron said that "ingrained in the brain of every litigator" is the general rule that an individual can appear pro se but a corporation must have counsel.


N.Y. Court Finds Litigator Entitled to 'Success Fee' in Citigroup Case

A New York court has ruled that noted litigator Stanley S. Arkin is entitled to a "success fee" for representing ex-Citigroup investment management chief Thomas W. Jones. Fired after a scandal which banned Citigroup from the Japanese private banking market, Jones hired Arkin to pursue a suit against Citigroup. The panel found that Arkin's retainer agreement "plainly refers to entitlements that will actually 'vest' ... not to entitlements that would have vested had Jones' employment not been terminated."


N.J. Supreme Court: Lawyer Fee Arbitrations Stay Private

The New Jersey Supreme Court has rejected a proposed plan to open fee disputes between lawyers and their clients to public scrutiny. The court gave no reason, but there had been vocal opposition to the proposal from the State Bar Association and county bars. The opponents argued that arbitration is by nature a private forum, designed to allow parties to resolve their differences out of the glare of publicity. The court also declined to adopt proposed amendments to the rules on multijurisdictional practice.


Attorney Loses Bid to Publish Name of Client's Accuser

The attorney for a well-known Broadway actor charged with sexually abusing a 15-year-old girl cannot publish the name of the alleged victim in order to investigate whether she has ever falsely accused a man of abuse, an appeals court in Manhattan ruled Thursday. Though the Appellate Division, 1st Department decided against him, it did express some interest in the claim that defense attorneys have long made that prosecutors have an unfair advantage when it comes to publicizing criminal cases.


Cross-Atlantic Compensation Suit Sinks

A London appeals court has ruled in favor of three London-based executives, rejecting their former New York-based employer's attempt to sue them in a U.S. court to recover ground lost when they left in April for a rival company. Parent company Marsh & McLennan looked to sue the three in New York over their compensation packages, but London's Court of Appeal said they can only be sued in courts in England, where they live and work.


Federal Judge Holds Off on Brocade Ruling

U.S. District Judge Charles Breyer left the white-collar community hanging Thursday when he declined to rule on a motion to acquit former Brocade Communications Systems chief executive Gregory Reyes of criminal charges related to stock option backdating. Breyer said he would reserve any decision for a later date. "I could decide immediately, a week from now ... before it goes to a jury or after," the judge said, adding that he may decide not to rule at all.


Media Mogul Conrad Black to Remain Free on $21 Million Bond

Former media mogul Conrad Black may remain free on a $21 million bond while awaiting sentencing for swindling the Hollinger International media empire he once ran out of millions of dollars, U.S. District Judge Amy J. St. Eve ruled Thursday. The judge turned down a request by federal prosecutors to have the Canadian-born newspaper executive jailed immediately lest he return to his native country and fight extradition. "I find clear and convincing evidence that Mr. Black is not going to flee," St. Eve said.


Teen Sex Case Reaches Ga. High Court

For more than a year, attorneys have been fighting the 10-year sentence levied on Genarlow Wilson for receiving oral sex from a 15-year-old girl when he was 17. In 2006, after Wilson had been sentenced for the incident stemming from a December 2003 party, lawmakers changed the state child molestation law in such a way that his lawyers say Wilson's conduct would now be considered only a misdemeanor. Today the highly publicized case lands squarely in Georgia's highest court.


Federal Judge Dismisses Valerie Plame's Lawsuit in CIA Leak Case

Former CIA operative Valerie Plame lost a lawsuit Thursday that demanded money from Bush administration officials whom she blamed for leaking her agency identity. Plame, the wife of former Ambassador Joseph Wilson, had accused Vice President Dick Cheney and others of conspiring to disclose her identity in 2003. Plame said that violated her privacy rights and was illegal retribution for her husband's criticism of the administration. A federal judge dismissed the case on jurisdictional grounds.

Nine Holes At the Local Dog Track

As you know, Mayor Fenty is taking over the schools here in the District of Columbia. As a parent with kids in public schools, I'm all in favor of Fenty's action. But the mayor needs to take the next, logical step: Assume full control of the public golf courses.

Let me ask you to picture a scene: Your faithful scribe is lining up a putt on the 17th green of Rock Creek Golf Course. It's roughly a 12-foot putt. My witness and playing partner is another journalist who can, if necessary, sign an affidavit affirming that what I am about to report is true.

Now, you're thinking to yourself, there's no way that he's going to hole the putt -- you know that I'm an artist, not a golfer. Others can master the links while I content myself with being a man of letters. Still, what is most sublime about golf is that, a couple of times a round, through some accident or miracle, the ball goes where it is supposed to go, more or less, accompanied by a prepossessing thwok, the golfer momentarily experiencing a hint of what it must be like to know how to play the game.

I enjoy an occasional trip to Rock Creek to knock the ball around. Rock Creek has enormous trees and lovely rolling terrain. It's cheap, it's right in town, it's never crowded. That said, it's not exactly Congressional Country Club. Some might call it a dog track. There's hardly a flat spot in the place, which is unfortunate if you are expecting your tee shot to remain in the fairway rather than dribble sideways into the woods. Moreover, something went disastrously wrong with the greens this summer. Basically, they died. They're mostly mud at this point. I'm guessing there was an herbicide disaster. It's like putting on the moon after a freak lunar rainstorm. They also have a strange blue tint, which is unusual for "greens." (Because of the problem, the greens fees are, I should note, half price.)

So as I'm lining up the putt, I'm coping with a major challenge: This 17th "green" is actually the 17th fairway. It is a "temporary green."

The only thing delineating the "temporary green" is a white circle spray-painted directly onto the grass.

The fairways at Rock Creek are not exactly manicured. They're a gaggle of various grasses spidering through the sandy soil. The temporary greens were rather desperate for a mowing. When I said it was roughly a 12-foot putt, I really meant "roughly."

One does not even attempt to roll a putt into the hole, but rather one hopes that the ball will somehow hop and bounce into the hole by random chance.

So I take my stance. I am determined to make this putt. I'm making all kinds of mental calculations. Normally I'd hit the ball rather gently, but since it must barrel its way through heavy grass, I need to give the ball a resounding whack.

I hit the putt.

Halfway to the hole, the ball vanishes.

Gone!

The ball just ... disappears.

It has gone into an undetected hole that had been lurking in the grass. The temporary green has eaten my ball.

This is the kind of thing that never happens to Tiger Woods. He never has to worry that one of his putts will disappear before it reaches the officially sanctioned hole. [Note the great Eli Saslow story on playing at Hains Point.] Nor does he have to cope with greens that look like the surface of an alien planet.

So Mayor Fenty, you need to ride to the rescue. Rock Creek could be a great, beautiful, fabulous golf course. Get out the bulldozers, the dynamite, the fill dirt, the grass seed, and just watch how, over time, we create a public golf course that blows away Congressional and Burning Tree and all those snobby clubs. It surely couldn't cost more than a few billion dollars.
