Mayer Brown Facing Lawsuit for $17 Million
As Mayer, Brown, Rowe & Maw readies for potential claims arising out of its representation of failed commodities brokerage Refco, the Chicago law firm's work for another bankrupt company has already triggered a $17 million suit against it. The bankruptcy trustee for defunct health care management company CMGT Inc. has sued its former lawyers at Mayer Brown for failing to challenge lawsuits brought against the company by its former financial adviser, Gerry Spehar.
Language Not in Fee Contracts Costs Firm More Than $35.7 Million
An arbitration panel has ordered the firm of Houston plaintiffs lawyer John M. O'Quinn to pay $35.7 million in damages to a class of 3,450 former breast implant clients who allege the firm overcharged them for expenses. With interest and attorney fees, the order calls for the firm to pay as much as $58 million to the plaintiffs and their attorneys. One of the arbitrators on the panel noted that plaintiffs lawyers have been "struggling for years" on how to handle general expenses in a mass tort case.
Google's Chief Legal Officer to Pay $700,000 in SEC Case
Google Inc.'s top in-house lawyer, David Drummond, has agreed to pay $700,000 to settle a Securities and Exchange Commission complaint alleging he helped mislead investors while overseeing the finances of his previous employer, SmartForce. The SEC had alleged Drummond helped SmartForce exaggerate its revenue by $113.6 million and its profit by $127 million during a 3 1/2-year period ending in mid-2002. At the time, Drummond was SmartForce's chief financial officer.

L. Clifford Davis sits alone in his office every Independence Day to contemplate his legal career that began July 4, 1949. A pioneering civil rights lawyer and former state district judge, Davis has accomplished plenty. When he arrived in Texas in 1954, racial segregation was prevalent, so Davis filed lawsuits that resulted in the desegregation of several school districts. He thought he wouldn't see the day when the Supreme Court reversed its course in desegregating public schools, which it did last month.
Movement Building to Abolish 'Locality Rules' in Med-Mal Litigation
A movement is slowly building to abolish century-old medical malpractice "locality rules" that judge a doctor's performance by the medical standards in the physician's community. Those laws, which are still on the books in 21 states, were originally designed to protect rural doctors who lacked access to medicines and training available in big cities. Now plaintiffs lawyers, courts, medical professionals and a handful of legislators are calling for the demise of such rules, calling them outdated and unfair.
U.S. Firms Beef Up Their Presence in Germany
A brisk German legal economy has prompted several U.S. firms recently to announce new openings or plans to beef up their presence in the country. Partners at leading U.S. law firms said they have seen strong private equity, inbound investments and a number of mergers and acquisitions in Germany and that they expect the trend to continue. Germany also ranked first in Europe for the number of patent filings in 2006, according to the European Patent Office.

Locke Liddell & Sapp on Thursday followed moves made earlier in the week by Houston-based firms Vinson & Elkins and Andrews Kurth, raising first- and second-year associate salaries in its Texas and Washington, D.C., offices to $160,000 and $170,000 respectively, effective Aug. 1. "It is always our intent to remain a competitive force in the marketplace," managing partner Jerry K. Clements wrote in an e-mail to associates. Locke Liddell is based in Houston and Dallas.
3rd Circuit Tosses Out Cosmetic Antitrust Suit
Giving quick effect to the U.S. Supreme Court's most recent business-friendly antitrust ruling, the 3rd Circuit has upheld the dismissal of a suit brought by a beauty supplies company that said it was the victim of a "group boycott" by distributors of so-called "salon-only" products. A unanimous three-judge panel found that the plaintiff failed to show the existence of a group boycott because its evidence "falls short of excluding the possibility that the distributors acted independently."
N.J. Supreme Court Censures Justice for Actions on Behalf of Bullied Son
The New Jersey Supreme Court on Friday issued a stern rebuke to one of its members for using the prestige of office to advance a personal interest. The court censured Justice Roberto Rivera-Soto for how he dealt with police, prosecutors and court officials over a complaint that his son was being bullied by a high school football teammate. The court said that Rivera-Soto engaged in a course of action that led to "an appearance of impropriety."

Sentenced to 10 years for receiving what's been called "voluntary" oral sex from a 15-year-old girl when he was 17, Genarlow Wilson was ordered released by a Georgia judge last month. An appeal of that ruling by the state attorney general -- and a second judge's refusal to give Wilson bond in the interim -- set up the case to be heard Friday by the Georgia Supreme Court. The justices heard arguments in a courtroom filled with a mixture of activists, politicians, lawyers and law clerks.
