N.Y. Federal Judge Strikes Down Many New Attorney Ad Rules
A federal judge has ruled unconstitutional most of the sweeping new restrictions on attorney advertising introduced this year by the New York courts. The restrictions had barred lawyers from such practices as using nicknames suggesting an ability to obtain results or touting "characteristics clearly unrelated to legal competence." Prohibitions on active client testimonials, portrayals of judges and fictitious law firms and the use of Internet pop-up ads were also struck down as unconstitutional.
Federal Judge Clears Law Firm Accused of Hacking Opponents' Web Archives
A ruling by Eastern District of Pennsylvania Judge Robert Kelly Jr., if it stands, wards off a potential judgment of $3 million in damages a patients' advocacy company sought from Harding Earley Follmer & Frailey for allegedly fetching protected pages using an archive search tool. Kelly found the firm was viewing Web pages that were publicly accessible -- even if mistakenly so. "They did not 'pick the lock' and avoid or bypass the protective measure, because there was no lock to pick," Kelly wrote.
Susman Godfrey Raises Associate Salaries
Susman Godfrey has joined the growing list of Texas-based firms opting to compensate Texas associates at rates comparable to their New York counterparts. The partners at Susman decided on Saturday to raise associate salaries effective Aug. 1 to $160,000 for first-years. Partner Shawn Raymond notes that, unlike the other Texas-based firms that announced salary increases, Susman is increasing the salaries of more senior associates without attaching any strings to the money or hesitating about doing so.
Law Grads Gush Over Prospects as Landmen
Because a disproportionate number of the landmen working in the energy industry are near retirement age, big energy companies recently began to recruit at law schools. Kassidy Knutson Opitz, a 2005 graduate of the University of Houston Law Center, who took a job as a landman at land broker Griffith Land Services, says it's a good job for quality of life -- the hours are pretty good despite the travel -- and because it's a stepping stone to a position as a title attorney or other real estate-related jobs.

9th Circuit Axes Bigger Panels
After a fleeting experiment with increasing 9th U.S. Circuit Court of Appeals en banc panels from 11 to 15 judges, the court has axed the bigger panels by reverting to the 11-judge reviews before the end of the planned two-year test. The 9th Circuit, the largest federal appellate court in the nation with 27 active judges, initiated the experiment in part after Sen. Dianne Feinstein, D-Calif., proposed it as a means of appeasing conservatives bent on splitting the circuit.

Chad Hennings, a former defensive lineman for the Dallas Cowboys, received a spine injury on the field that ended his career. But according to a Texas appeals court, he is not a successful workers' compensation claimant. In a case of first impression, the court rejected Hennings' workers' comp claim, holding "that a professional athlete who accepts the benefits available under his contract or collective bargaining agreement cannot recover under [the Texas workers'] compensation law."
Ex-Associate Pleads Guilty to Trading Scheme
A former associate at Thacher Proffitt & Wood has been sentenced to 33 months in prison following his guilty plea to a $2 million insider trading scheme. Amir Rosenthal received inside information from his father, Zvi, about Taro Pharmaceutical Industries, where Zvi was a vice president. The company was not a Thacher client and no client information was used in the scheme.

Panel Reverses Judge's Calculation in Tobacco Settlement
A Manhattan judge's dismissal of an economics consulting firm's estimate of the cost of payments under a 1998 tobacco settlement has been reversed by a New York appellate panel. The firm had been selected to determine whether the 45 cigarette makers that participated in the accord were entitled to a reduction in their payments because they had lost market share to companies that did not sign the pact.

Frustrated by delays in health care, injured Iraq war veterans accused VA Secretary Jim Nicholson in a lawsuit of breaking the law by denying them disability pay and mental health treatment. The lawsuit against the U.S. Department of Veterans Affairs, filed Monday in federal court in San Francisco, seeks to represent between 320,000 and 800,000 veterans of the Iraq war. Ultimately, a federal judge will have to decide whether the lawsuit is properly deemed a class action that adequately represents them.
