Chief Justice Described as Fully Recovered in Hospital After Seizure, Fall

Chief Justice John Roberts was reported fully recovered Monday from a seizure and fall at his seaside summer home, in which he experienced minor scrapes but no serious injuries. Supreme Court spokeswoman Kathy Arberg said that Roberts, who had a similar episode in 1993, would remain overnight in a Maine hospital. By definition, someone who has had more than one seizure without any other cause is determined to have epilepsy, said a neurologist not involved in the Roberts case.


Judge Finds Tobacco Settlement Bars Claims for Punitive Damages

A federal judge has ruled that New York's participation in the nationwide $208 billion settlement reached in 1998 between 46 states and the tobacco industry bars subsequent claims for punitive damages in smokers' damage actions in New York. The judge also rejected a design-defect theory that led to a $20 million verdict against two cigarette manufacturers in a separate 2005 state case. More than $17 million of that verdict stemmed from an award of punitive damages.


Firm Resolves Dispute in KPMG Tax Probe

California lawyer William A. Goddard and his former firm, Lee, Goddard & Duffy, have reached an agreement with federal agents who are seeking documents related to the criminal investigation of fraudulent tax shelters sold by accounting giant KPMG. The firm turned over 10,000 pages of documents, but rejected an IRS agent's request for additional information related to 24 individuals and companies, court papers say. It's unclear whether Goddard could face civil penalties or criminal charges.

Former Deputy Attorney General Paul McNulty announced Monday that he has joined Baker & McKenzie as a partner in the firm's Washington, D.C., office. He will have a hand in the business crimes and investigations, corporate compliance and risk management, and global dispute resolution practices. McNulty testified before the Senate Judiciary Committee on the U.S. Attorney scandal, pointing out White House involvement. He resigned his post in May, citing "financial realities of college-age children."


Nike Settles Race Discrimination Lawsuit for $7.6 Million

Nike has reached a $7.6 million settlement in a class action race discrimination lawsuit filed on behalf of 400 black employees of the company's Chicago Niketown store, the company said Monday. The lawsuit, filed in 2003, alleged that managers used racial slurs to refer to black workers and customers, that the store segregated black employees into lower-paying jobs as stockroom workers and cashiers, and that managers made unfounded accusations of theft against black workers. Nike has denied the allegations.


Rohm & Haas Faces Medical Monitoring Suit

Predicting that the Supreme Court of Illinois "is likely to recognize" a claim for medical monitoring, a federal judge in Philadelphia has refused to dismiss a class action suit brought by residents of an Illinois town who claim that groundwater contamination has caused a cluster of brain cancer cases. Named as defendants are Rohm & Haas Co. and its subsidiary, Morton International Inc., the maker of Morton Salt, and Modine Manufacturing Co., a manufacturer of heating and cooling technology.


Complaints Filed Over Discounted Fees for Texas Justice Caught in Miers Nomination Flap

Prosecutors are investigating whether Texas Supreme Court Justice Nathan Hecht received an illegal gift when Jackson Walker discounted its legal fees for representing him in his successful challenge of the state judicial conduct commission's public admonition of him for his support of Harriet Miers' failed nomination to the U.S. Supreme Court. Citizens' group Texas Watch alleges in complaints filed last week that Hecht may have broken the law or violated judicial canons in accepting the discount.


Software Company Hopeful No Bar Exam Essays Will Be Lost

The Massachusetts company that provided the software for students using laptops for the New York state bar examination last week said it believes no essays will be lost due to computer problems, the New York state Board of Law Examiners said. Students reported problems saving the essays on their computers, and later uploading the essays onto the company's Web site for transfer to the state for grading.
