We had our Outlook meeting yesterday and it looks like I'm writing about busing (some people insist on spelling the word "bussing" -- but isn't that kissing??? I'm sure I'm right -- check AP style) circa 1970. Pegged to the Supreme Court's recent decision revisiting (gutting?) Brown v. Board of Education. I was bused across town for 5th and 6th grade as part of a court-ordered desegregation plan. There's a piece in there somewhere. If anyone remembers that era (particularly in the Deep South), please post a comment. Or just write the article for me. Thank you.
[The New Guy -- I might as well tell you his name -- Newman -- says, "Our readers know more than we do." Or something like that. Maybe that's someone else's line and he's endorsing it. In any case, he insists on me blogging about what we're doing in the upcoming Outlook section. The idea is, the Internet lets us be more collaborative and less, I don't know, hierarchical, and omniscient, and bossy. I agree in principle, but continue to worry that if we get any more collaborative, people will begin demanding payment, and a vacation plan and a 401k. The A-blog is Ground Zero in that future legal nightmare.]
At one point during the Outlook meeting, my editors suggested that I come up with some actual facts about busing and school desegregation.

WHAT!!??? RESEARCH??? I was flabbergasted.
The impertinence.
It's like they don't know who they're dealing with.
There was also discussion about other Outlook stories coming up this weekend. Something about the Mideast. Something about Intelligence Reform. Or maybe the Mideast story and the Intelligence Reform story are the same story.
I am pretty sure stories about the Mideast spontaneously generate in the Outlook office. There are ancient Mideast-punditry spores in the carpeting.
Also we have stories arriving from local think tanks via pneumatic tubes that date to the 1950s. At the mouth of each tube is a label: Brookings, CSIS, AEI, Heritage. I find the whooshing sound to be highly distracting.
Also there might be a story this weekend on politics and sex. Hear hear!! (Or do I mean Here Here?) (Don't answer that.)

Did the top lawyer at Merial Limited mislead court officials about his resume? Horace "Hod" Nalle appears to have been general counsel of the multibillion-dollar animal pharmaceutical company for a decade, according to several sources. But in a recent application to renew his Pennsylvania law license -- which he let lapse in 2002 -- Nalle made no mention of being general counsel. The omission didn't seem to bother disciplinary officials, who in June recommended his reinstatement.

A federal civil jury came back after deliberating for five hours on Monday and said there was not enough evidence against the owner of Macy's department stores to prove a price-fixing conspiracy in the high-end tableware market. D.C. Circuit: Damages for Emotional Distress Part of Gross Income
Money for your mental anguish is taxable. That was the ruling Tuesday from a panel of the D.C. Circuit, which reversed what it said just 11 months ago. The decision came in the case of Marrita Murphy, who was awarded damages for emotional distress and loss of reputation after she complained to authorities of environmental hazards at the New York Air National Guard base. After siding with Murphy last August, the panel now concludes that taxable income includes compensatory damages for non-physical injuries.
Wage Disputes Over Donning Gear Fuel Suits
In lawsuits filed across the nation, employees from auto workers to poultry workers are suing to be paid for the time it takes to get ready for work. Many of the lawsuits are fallout from a 2005 U.S. Supreme Court case involving poultry and meatpacking workers in which the high court ruled that employees should be paid for the time it takes to "don and doff" mandatory uniforms or equipment. And one of the biggest groups of employees bringing these lawsuits is police officers.
3rd Circuit Panel Reverses Lawyer's Disqualification in Employment Case
No ethical rules are violated when a plaintiffs lawyer in an employment discrimination case communicates directly with another employee of the company if that worker is not in a position of authority and does not communicate regularly with the company's lawyers, the 3rd Circuit has ruled. The panel reversed a decision by U.S. District Judge Gene E.K. Pratter, who disqualfied attorney Jana Barnett after finding that she had "manipulated" an employee to get access to privileged and confidential information.
Lead Attorney Absent From Record Producer's Murder Trial to Tape TV Show
Phil Spector's lead attorney has decided the record producer's murder case can continue just fine without jurors seeing one key element -- himself. Bruce Cutler, the New York lawyer who opened the proceedings in April as the star performer, is taking time out from the 10-week-old trial to film a new courtroom TV show, "Jury Duty." Cutler might not be breaking any ethical rules by taping the show during the trial, but "it's certainly unorthodox," said Loyola University Law School professor Laurie Levenson.
New Parmalat Loses Its Bid to Dismiss Old Class Action
Parmalat, the Italian dairy company that reorganized after being forced into bankruptcy over an accounting fraud scandal, has failed in its bid to convince a Manhattan federal judge to dismiss a securities class action suit against it. The new entity argued it should not be held liable for transgressions of its predecessor. But the judge held that the new company, as the "successor" of the old Parmalat, was liable for payment of the claims pursuant to the terms of an Italian bankruptcy plan.

Former Milberg Weiss Partner Refutes 'Honest Services' Charges
Former Milberg, Weiss & Bershad partner Steven Schulman expanded his motion to dismiss some of the criminal charges against him with additional court filings last week. Schulman and another Milberg Weiss partner, David Bershad, were indicted in Los Angeles last year on charges they made $216 million in attorney fees by paying kickbacks to lead plaintiffs. Schulman's most recent filing seeks to dismiss counts of "honest services fraud" relating to four federal cases in which he is linked in the indictment.
Attorney Has Less Severe Form of TB Than Previously Thought, Official Says
The globe-trotting American lawyer who caused an international health scare by traveling while infected with tuberculosis has a less severe form of the disease than previously diagnosed, a federal health official said Tuesday. Andrew Speaker was initially told he had extensively drug resistant TB, but three later tests have all shown that he has multidrug-resistant TB, a milder form of the disease, the official said.
Kidnapped Atlanta Lawyers Freed After Text-Messaging for Help
Two Atlanta lawyers were rescued by police Monday after one of the lawyers sent a text message to his brother: "We have been kidnapped. Please call the police and help us." David Deganian and Herman Hoying were kidnapped by four armed men after leaving a bar early Sunday morning. The pair were stripped of their wallets, keys and cash, but the robbers missed seizing the young lawyers' cell phones. Police credited the kidnapped men for not panicking during their ordeal.
