O'REILLY: ... As you may know we've been reporting on most of the Democratic candidates attending the Kos Convention this weekend. Despite the fact that Web site is full of hateful postings including this picture of President Bush and Senator Joseph Lieberman which has been on the site for a year. Now yesterday I spoke with Senator Chris Dodd who is running for president and will be at that convention.

O'REILLY: You've known Senator Lieberman for 30 years. You know President Bush. I'm sure you respect both men as patriots. And you see something like this [doctored photo of Lieberman kneeling before Bush as though he's about to perform oral sex] Why don't you distance yourself from it, sir?

DODD: Well what I'm stunned at, Mr. O'Reilly, is the fact that you spend as much time going after an online community gathering where there are 500,000 people visit who visit that site on a daily basis here, to identify five, six, seven, objectionable offensive cartoons or comments that people are making here. I find that stunning to be quite honest, here.

O'REILLY: This is the worst stuff on the Internet.

DODD: Let me finish.

O'REILLY: There isn't any worse than this.

DODD: You're missing the point. You ought to be far more candid with your viewing audience and tell them that your real objection is the ideology of Daily Kos not what's -- this is silliness for you to be suggesting that of 500,000 .

O'REILLY: If you went to the .

O'REILLY: Hold it.

DODD: Out of 500,000 people every day. Why are you attacking like this?

O'REILLY: What about that cartoon, senator, what about it.

DODD: No. Listen.

DODD: Mr. O'Reilly, you are not listening to me. The mere point here is you are not being candid. Your objection is to this community gathering here. You don't like their politics.

O'REILLY: I don't like their Web site.

DODD: That's a legitimate criticism. Why don't you focus on that and recognize that 500,000 people.

O'REILLY: I'll ask you the question again. Are you OK with that cartoon, sir?

DODD: Of course not. That's not the issue, Mr. O'Reilly.

O'REILLY: Of course. It's the issue. That's what they do on the site. They do hate stuff all the time.

DODD: You suggested that we ought not to participate in the convention.

O'REILLY: Correct. Distance yourself from them.

DODD: Because six or seven or eight or 10 people have said something on the site that's objectionable.

O'REILLY: What are you crazy. There's thousands of vile postings on that Web site. Thousands.

DODD: There are thousands on your posting as well.

O'REILLY: No there aren't any on my posting. We take them off.

DODD: Talking about Al Qaida attacking San Francisco, blowing up San Francisco.

O'REILLY: When did I say that, senator?

DODD: You said it in 2005 I think is correct.

O'REILLY: What forum? When?

DODD: Right here I believe on your show.

O'REILLY: You are wrong. I didn't say it here. You don't know what the hell I said with all due respect. You got it from Media Matters. You didn't hear it and you don't know.

Judge Who Sued Over Lost Pants May Now Lose Reappointment

Administrative Law Judge Roy Pearson Jr. became the poster boy for frivolous lawsuits with his $54 million lawsuit against a dry cleaner over a lost pair of pants. But questions about his temperament as a judge had surfaced long before the media firestorm. Since his initial two-year term expired in May, Pearson has been sidelined from the bench. A commission that reappoints administrative law judges is expected to vote today on the first step toward denying Pearson's appointment to a full 10-year term.


Ky. Judge: Fen-Phen Lawyers Owe at Least $62 Million to Former Clients

Three attorneys accused of bilking their clients in a diet drug settlement must repay at least $62.1 million in settlement funds and interest, a Kentucky judge ruled Friday. Special Judge William Wehr ordered William J. Gallion, Shirley A. Cunningham Jr. and Melbourne Mills Jr. to repay $42 million taken from the settlement and $20.1 million in interest. The attorneys are being sued by about 400 former clients who claim the lawyers took too much money as part of a $200 million fen-phen settlement.

There's a growing tension between law firms and some current or former employees who post negative or confidential information about the firms online. In the past year, at least two blogs, Skadden Insider and Above the Law, have raised eyebrows for publishing internal information, such as confidential firings and sexual trysts with partners. David Lat, editor of Above the Law, says the blog promises anonymity, which helps people act on their "human instinct" to "unburden themselves of a secret."


Law Professor Helps Atlanta Company Become Sole Owner of Titanic Artifacts

Thanks to Emory University law professor and maritime law expert David J. Bederman, an Atlanta company can now make the claim that artifacts recovered from the Titanic wreck site are theirs, all theirs. Premier Exhibitions Inc. has finalized an agreement with a British insurer to acquire ownership of Titanic artifacts in Premier's possession. While Premier had recovered the artifacts in seven separate expeditions to the Titanic wreck site, it had done so only under the legal status of salvor-in-possession.


N.J. Appeals Court: Client's Illegitimate Purpose Isn't Necessarily the Lawyer's

A New Jersey state appeals court has cleared a law firm of malicious civil prosecution in a decision that champions the right of lawyers to advocate zealously even when they know a claim is baseless. The court found that lawyers cannot be liable for malicious prosecution unless they are acting for an illegitimate purpose of their own. And the fact that a client has an illegitimate purpose does not automatically mean the lawyer does too.


Federal Judge Rejects Plea in Case of Disbarred Attorney -- Again

Prosecutors last week resubmitted a plea agreement calling for disbarred Miami attorney Louis Robles to get 10 years in prison and forfeit $1 million at sentencing. In a rare move, U.S. District Judge Alan S. Gold in May rejected the agreement, which requires Robles to admit to two mail fraud counts in a 41-count indictment. This time, prosecutors included stories of Robles' sick and dying victims. Unmoved, Gold rejected the agreement again, setting up either a trial or a change in terms.


Californian Can Be Sued in N.J. for Alleged Libel on Internet

A New Jersey appeals court has ruled that a California resident accused of making libelous statements in a Web-based forum can be sued in New Jersey because the material was "targeted" toward a New Jersey audience. Many state courts have ruled that posting libelous material in open forums does not vest jurisdiction in the victim's state. But because the material was directed toward a New Jersey resident, the defendant had reason to foresee he would be hauled into court in that state, the appeals court held.


Thelen Wins Fight With French Whistleblower Over $54M Fee

A battle over $54 million in fees between Thelen Reid Brown Raysman & Steiner and a French whistleblower has come to an end for now. U.S. District Chief Judge Vaughn Walker has ruled for the firm in its dispute with Francois Marland over a fee-sharing agreement. Judge Walker granted Thelen's summary judgment motion, ruling that the agreement allotting Marland a $19 million cut of the fees won in a case on which Marland assisted, which alleged fraud by French banks, was valid and enforceable.


Roberts' Seizure Focuses Attention on Justices' Health, Privacy

Two Supreme Court justices have had cancer. Another has a stent to keep an artery open. Now the chief justice has suffered his second unexplained seizure in 14 years. KPMG Defendants Seek Postponement of Trial

Following the dismissal of charges against 13 of the 18 ex-KPMG employees in , the remaining five defendants in the criminal tax fraud case have asked Southern District of New York Judge Lewis A. Kaplan to adjourn indefinitely the Oct. 16 trial date. "The remaining defendants and their counsel will not be prepared to defend this case appropriately by mid-October," attorneys for the defendants said in court filings.
